Lohan smashed during crash? This is what van driver, Raymundo Ortega is claiming in a law suit filed yesterday against the then 19 year old actress who smashed into his vehicle on Robertson Blvd in LA on 4th October 2005. Ortega's suit against Lohan and the famous Ivy restaurant, where Lohan dined before the crash, is claiming that the Lohan –consumed alcohol and became intoxicated" just before the accident. Ortega is suing for damages in excess of $200,000 to include medical bills, lost wages, loss of his vehicle and pain and suffering. The suit also claims that Lohan was driving recklessly at approximately 60 mph in a business district while looking over her shoulder, "Lohan's actions were malicious, wanton, willful, and reckless and showed a conscious disregard for the safety and welfare of others". The suit goes on to allege that the Ivy allowed Lohan to drink even though she wasnêt of legal drinking age before she got behind the wheel of her Mercedes. –At the time The Ivy sold, gave, and/or served Lohan alcoholic beverages it knew that Lohan was 19 years old and a minor.”
